This Disclaimer governs the User’s access to and use of www.flourishbehavioural.com (the “Website”), including any content, functionality, and services offered on or through this Website owned by Fera Applied Behaviour Analysis Professional Corporation, a company incorporated in the Province of Ontario doing business as Flourish Behavioural Health and Education (the “Company”). The User agrees to be bound by the terms herein.

We highly encourage the User to read this Disclaimer, along with our Terms and Conditions and Privacy Policy, before exploring this Website. By virtue of the User’s use of this Website, they will be deemed to have accepted the terms outlined herein.

The Company values User success and enjoyment, and strives to provide knowledge and high-quality services, but the Company makes no guarantees whatsoever of any results from the use of the Company Website, products, and services or regarding the availability, accuracy, or reliability of any services, pricing provided on the Website. This includes but is not limited to behavioral or developmental outcomes, personal growth, emotional well-being, satisfaction with any program, or any other results or benefits that may be expected from the Company’s products or services.

By accessing the Website or otherwise engaging with the Company, the User fully assumes those risks involved. These risks include but are not limited to, emotional or psychological stress, unexpected emotional breakthroughs or the surfacing of unresolved trauma, frustration, fatigue, or stress associated with behavior change, variability in treatment outcomes, misinterpretation or misuse of general educational content, and other unforeseen circumstances beyond the Company’s control. The User has freely and voluntarily chosen to access the Website or otherwise engage with the Company and understands that the nature of the products and services require a certain level of risk.

5.4 The User acknowledges that although members of the Company are registered Psychologists by the College of Psychologists and Behaviour Analysts of Ontario, and Board Certified Behaviour Analysts certified by the Behavior Analyst Certification Board, this Website does not do not create a psychologist-client or behavior analyst-client relationship in any manner. Any information, content, or materials available on this Website are provided for general and information purposes only and should under no circumstances should be interpreted as, or be construed as, or a substitute, for professional advice. The Company expressly recommends that Users seek individualized advice, diagnosis, or treatment from an appropriately qualified professional for their own circumstances.

5.5 The User accepts and understands that the Company is not able to monitor the User at all times during the services offered on the Website, nor is it the Company’s responsibility to ensure the User has complied with personal requirements or mental readiness. The User accepts that any harm or injury that is caused as a result of their participation in their access to the Website and/or engagement with the Company is at their own risk and waives all liability of the Company. The User agrees they are participating voluntarily and understands the risks associated.

6.2 Further, the Company shall not be liable for any injury, loss, death, inconvenience, delay, or damage to the User or the User’s property arising from or in connection with the provision of any products or services offered on the Website or by relevant third parties. This shall include, but is not limited to, incidents resulting from acts of God or force majeure, illness or disease, war, civil unrest, insurrection, animal encounters, labour disruptions, criminal or terrorist acts, overbooking or changes to accommodations, mechanical failures, or delays or malfunctions of transportation services.

6.3 To the fullest extent permissible by applicable law, the Company, and by extension its owner, and any operators, employees, or contractors of the Company will not be held responsible for any form of damages and/or legal claims against it based out of the User’s participation in using this Website or through their participation and use of any products or services sold through the Website.

7.1 If any provision of this Disclaimer shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Disclaimer is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
